Anthony R. Friedman has been put on notice - Pending Civil Litigation


Anthony R. Friedman, attorney Mo Bar Number #65531 as of Oct. 22, 2025 has been put on notice of pending civil litigation when a U.S.P.S. certified mail, return receipt was signed for at his advertised business address at 6209 Mid Rivers Mall Dr. Ste. 204 St. Charles, Missouri 63304.


The document that was received is a formal notice, demand to preserved evidence in a forth coming civil claim to be filed in circuit court naming Anthony R. Friedman et al. as defendants in a legal malpractice complaint. 


Therefore, the receipt of this notice creates a duty upon Friedman to advise any and all current or future clients of the pending action and seek informed consent to either accept representation or continue representation. --- A failure to do so may be a cause of legal malpractice should a potential client or current client be harmed by the conduct, misconduct of Friedman during representation that would suggest a conflict of interest or that the representation may be compromised to the detriment of a client.

⚖️ Public Service Advisory: A Lawyer's Personal Jeopardy is the Client's Right to KnowAn attorney's personal legal issues, such as being notified of an imminent disciplinary complaint or a civil lawsuit (e.g., for malpractice), trigger serious ethical disclosure duties to their current clients. This is not optional; it is required by the rules governing professional conduct to ensure client loyalty and competent representation.


1. The Conflict of Interest (Rule 4-1.7)

An imminent disciplinary action or lawsuit creates a "personal interest" conflict for the lawyer that can threaten the client's case.


  • The Rule: A lawyer must not represent a client if there is a "significant risk that the representation... will be materially limited by... a personal interest of the lawyer." (Mo. R. Prof. C. Rule 4-1.7(a)(2)).


  • The Argument: Facing a lawsuit or disciplinary probe (OCDC) may compromise the lawyer's independent judgment. The lawyer may subconsciously prioritize strategies that minimize their own personal liability (e.g., avoiding a particular witness, filing a motion, or settling a case) over the best interests of the client.


  • The Resolution: If a personal interest conflict exists, the lawyer must fully disclose the situation and its potential impact on the representation. The lawyer can only continue if they reasonably believe they can still provide competent representation and the client gives informed consent, confirmed in writing. (Rule 4-1.7(b)).


2. The Duty to Communicate (Rule 4-1.4)

A client cannot make informed decisions about their case if critical facts about their lawyer's limitations are withheld.


  • The Rule: A lawyer is required to "keep the client reasonably informed about the status of the matter" and "explain a matter to the extent reasonably necessary to permit the client to make informed decisions regarding the representation." (Mo. R. Prof. C. Rule 4-1.4(a)(1) & (b)).


  • The Argument: The threat of a lawyer's potential disqualification or the severe distraction caused by defending against a malpractice or disciplinary action are significant developments that affect the substance of the representation. This information is vital for the client to decide whether to continue with that counsel or seek new representation.


The Bottom Line: A formal notification of an impending lawsuit or disciplinary action is a material fact that an attorney cannot ethically withhold from their client. The guiding principle is Loyalty and Independent Judgment—if the lawyer's personal legal troubles threaten those qualities, they must disclose or withdraw. (See also: Mo. R. Prof. C.
